Terms of Service

These terms apply to every quote, agreement, and use of the Rec-Motion platform byRecruitment Intermotion, KvK 86174355, VAT NL004204089B62 ("Rec-Motion", "we"), unless agreed otherwise in writing.

1. Definitions

• Platform: the Rec-Motion workspace and the apps available in it
• Customer: the party entering into an agreement with Rec-Motion
• Workspace: the Customer's isolated environment within the Platform

2. Formation of the agreement

An agreement is formed once Rec-Motion confirms a quote in writing (email suffices), or once the Customer activates a paid subscription.

3. Use of the Platform

The Customer receives a non-exclusive, non-transferable right to use the Platform for the duration of the agreement. The Customer is responsible for use by its own users and for the accuracy of data it enters into the Platform.

4. Availability and maintenance

Rec-Motion aims for high availability of the Platform but does not guarantee uninterrupted operation. Planned maintenance is announced in advance where reasonably possible.

5. Pricing and payment

Prices are stated excluding VAT. Invoices must be paid within the agreed term. Access to the Platform may be suspended in case of late payment.

6. Term and termination

The agreement runs for the period stated in the quote and renews automatically thereafter unless terminated in writing within the notice period stated in the quote.

7. Data processing

To the extent Rec-Motion processes personal data on the Customer's behalf under this agreement, the GDPR & processing page and the data processing agreement it contains apply.

8. Liability

Rec-Motion's liability is limited to the amount paid by the Customer in the twelve months preceding the event causing the damage, except in case of intent or gross negligence.

9. Governing law

These terms and every agreement are governed by Dutch law. Disputes are submitted to the competent court in the district where Rec-Motion is established.
